These Terms of Use ("Terms") govern your access to and use of johnslyng.com (the "Site"), operated by Johns Lyng USA, LLC and its affiliated brands and subsidiaries (collectively, "Johns Lyng USA," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

1. About Johns Lyng USA

Johns Lyng USA is a building and restoration services group operating in the United States through its brands, including Reconstruction Experts, Steamatic, Advanced Roofing & Sheet Metal, Johns Lyng Makesafe & Reinstate, Timberline Reconstruction, Express Reconstruction, RE Expert Services, Project Solutions, and Bespoke Property Maintenance (collectively, our "Brands"). Johns Lyng USA is part of the Johns Lyng Group, headquartered in Australia.

2. Informational Purposes Only — No Contract for Services

The content on the Site is provided for general informational purposes only. Nothing on the Site constitutes a binding offer, quote, estimate, or contract for construction, restoration, roofing, remediation, or any other services. All services are provided only under a separately executed written agreement, work authorization, or contract between you (or the responsible party) and the applicable Johns Lyng USA entity, and those written agreements govern in the event of any conflict with the Site.

Any pricing, timelines, project descriptions, or scope information on the Site are illustrative only. Actual pricing and scope depend on inspection, site conditions, applicable codes, insurance determinations, and other factors, and will be set out in your written agreement.

3. No Professional Advice

Content on the Site — including blog posts, guides, and resources about property damage, mold, water or fire mitigation, roofing, construction defects, or insurance claims — is general information and is not engineering, legal, insurance, or other professional advice. You should not act or refrain from acting based on Site content without obtaining advice specific to your situation. In an emergency involving risk to life or safety, call 911.

4. Eligibility and Permitted Use

The Site is intended for users who are at least 18 years of age and located in the United States. You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable law or regulation

• Submit false, misleading, or fraudulent information through Site forms, including fraudulent insurance claim information

• Attempt to gain unauthorized access to the Site, its servers, or connected systems

You may view, download, and print Site content for your personal, non-commercial use only, provided you keep all copyright and proprietary notices intact.

If you submit information through the Site — such as inquiry forms, service requests, employment applications, reviews, or feedback — you represent that the information is accurate and that you have the right to provide it. We do not control and are not responsible for the content, accuracy, or practices of third-party sites, and a link does not imply our endorsement.

10. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT CONTENT ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT. THIS SECTION APPLIES TO THE SITE ONLY AND DOES NOT LIMIT ANY WARRANTY EXPRESSLY PROVIDED IN A WRITTEN SERVICES AGREEMENT WITH US.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JOHNS LYNG USA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. THIS SECTION APPLIES TO USE OF THE SITE ONLY AND DOES NOT LIMIT OR MODIFY LIABILITY UNDER ANY WRITTEN SERVICES AGREEMENT WITH US.

12. Indemnification

You agree to indemnify, defend, and hold harmless Johns Lyng USA and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party in connection with the Site.

13. Governing Law and Disputes

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. You agree that the state and federal courts located in Jefferson County, Colorado will have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue in those courts.

Nothing in this Section applies to disputes arising under a written services agreement with us, which are governed by the dispute resolution terms of that agreement.

14. Changes to the Site and These Terms

We may modify, suspend, or discontinue the Site (or any part of it) at any time without notice. We may also update these Terms from time to time. The "Effective Date" above reflects the most recent version. Your continued use of the Site after updated Terms are posted constitutes acceptance of the updated Terms.

15. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Johns Lyng USA regarding use of the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
